Allegedly 'under the influence of a drug,' man assaults police officer, reserve constable

An agitated man allegedly “under the influence of a drug” assaulted a Nelson Police Department officer and a reserve constable Saturday morning after they were called to remove him from a local hostel.

The officer attempted to arrest the accused, Riley Devin McNally, 24, for assault by trespass, but the partially clothed male allegedly resisted and assaulted the officer.

Around 8:26 a.m. Saturday morning staff from a local hostel called police to report a male was refusing to leave their building.

The NPD officer was confronted by an agitated 24 year-old man who appeared to be under the influence of a drug, read an NPD police release.

“The male would not leave when asked to do so and became confrontational with the police.”

When a reserve constable attended to assist, he was also allegedly assaulted. The officer and reserve constable were treated and released from Kootenay Lake Hospital with minor injuries.

McNally, who recently moved to Nelson, was charged with assaulting a police officer and a reserve constable, resisting arrest, carrying a weapon for a purpose dangerous to public peace, carrying a concealed weapon, causing a disturbance and mischief under $5,000.

McNally was remanded in custody during a bail hearing and is scheduled to attend Nelson Provincial Court Tuesday.
