Surprise adjournment in WKES Jumbo Municipality court case
Before the case was even heard by a judge, the West Kootenay EcoSociety sought, and was granted, an adjournment after receiving an amended response and new evidence from lawyers for the municipality at the eleventh hour.
The adjournment, according to WKES lawyer Judah Harrison, gives EcoSociety an opportunity to respond to the latest filings.
“On the same day that the Petition Record was to be filed (Thursday) we received an amended response, and an affidavit from lawyers for the municipality,” Harrison said in an email to The Nelson Daily.
“We sought an adjournment to allow us to respond.”
The WKES was set to take its case to BC Supreme Court in Vancouver to challenge the provincial government’s 2012 decision to establish the Jumbo Glacier Resort (JGR) Municipality.
WKES lawyers Harrison and Jason Gratl were to ask the judge for a judicial review of a decision by the Minister of Tourism, Sport and Community to recommend the auditor general approve the JGR Municipality, and also the auditor general’s decision to approve the municipality.
Instead the adjournment sought by the WKES means the case will be put off until the next available court date, which is May 2015.
